In this talk, Taylor Asen will discuss what gambling can teach us about trial law. Professional gamblers succeed by making bets that are "positive expected value." That's what good trial lawyers do as well. And in the era of data analytics and statistical modeling, it is more possible than ever for us to make decisions about when to go to trial that, in the aggregate, will increase the value of our cases. The problem is that decisions that are good for us--and are good for our clients "in the aggregate"--put enormous amounts of risk on individual clients who can least afford it. How can we maximize value for our clients while protecting them from the downside of risk?
