In the early morning hours of September 12, Mercedes, a 97-year-old woman, was found on the floor of her assisted living room with a bump on her head. She was not sent to the hospital for evaluation. Over the next 3 days, she was given blood thinning medication because of an existing heart condition. The morning of September 15, her family visited her and discovered she could no longer speak coherently. 911 was called, and she was transported to the hospital with a large brain bleed.
Although her prognosis was negative, she miraculously started to recover and was transferred to a nursing home for rehabilitation. The nursing home was unaffiliated with the facility she had recently fallen at.
Extremely fragile and with extensive swelling around her brain, she entered the new nursing home for rehabilitation. The first day she was there, the nursing home allowed her to fall. The nursing home did not send her to the hospital for evaluation. Once again, three days later, her family visited and saw that she was incoherent. She was sent to the hospital where she was diagnosed with a new brain bleed from a head injury. This time she did not survive.
The medical examiner (coroner) determined that the cause of death was blunt force trauma to the head the combination of falls at the two facilities.
Michael will be asking the jury for in excess of $50 million in compensatory damages.
During jury selection, Michael will be addressing:
·Jury team building and identifying what makes each juror a valuable member of the jury team
·Credibility/believability of witnesses and identifying the presence of lying
·Distinguishing evidence from distractions
·Appraising true value of life regardless of age or disability
·Standard of care as job performance
·Burden of proof
·What evidence is inside the box (can be considered) vs outside the box (cannot be considered)
·Bias
·Blaming the family
