From choosing the right case to filing, discovery, and trial, Kurt walks through exactly how to build a strong premises liability claim from the ground up. You'll learn how to approach early actions like site inspections, expert hires, and claim setup, plus how to plead PLA vs. negligence.
We'll dive deep into discovery — what documents to request, how to structure 30(b)(6) depositions, and how to handle ESI. You'll get real strategy on depo order, how to prep your client, and how to press fact witnesses when it matters. Then it's trial time: MILs, demonstratives, focus groups, witness order, and jury selection. You'll learn what to ask (and what not to), how to open with power, and how to cross defense witnesses with drama and purpose. Finally, we'll walk through closing and rebuttal — including what to hold back until the very end.

Steve Straughen was a well site supervisor at an oil and gas frack site. All of the oil extracted from the ground was being deposited in large frac tanks - rectangular tanks about the size and shape of a mobile home. While investigating strange sounds from the top of the tank, the tank exploded sending Steve 50 feet into the air. Steve survived with severe orthopedic injuries, but ultimately lost his leg. The tanks exploded because they were poorly maintained and delivered to the site with holes in them.

Oil and Gas Worksite Injury - Our client was injured when an oil and gas storage tank exploded while he was on top of it.
Premises Liability - Our client suffered severe nerve injuries and developed CRPS from an electric injury while working.

In the last 10 years, starting at the age of 35, Kurt has splashed the front pages of National and Colorado newspapers, and has become a mainstay in the news media for his high profile and record-breaking verdicts. He has appeared on Good Morning America, World News Tonight, and every local media outlet including the Denver Post and local CBS, ABC, and Fox affiliates. He consistently records the largest personal injury verdicts in Colorado year after year, having secured the largest premises liability verdict in the history of Colorado.
He is also a published author of Federal and State case law, including Colorado law establishing the right to punitive damages for victims of drunk drivers and spoliation; he also authored articles and taught on ancient Roman trial methods.
As a trained stage actor, Kurt credits much of his trial success to his theatrical training in college and in Los Angeles prior to law school. After graduating law school near the top of his class, Kurt went on to clerk for United States District Judge Ken Marra, learning from behind the bench.
As a human, Kurt spends much of his time with his wife and three young boys outdoors in the mountains, on the stage in a local theater production, Or, perfecting Kempo with his three boys in their dojo. He are some of his ruminations on who he is (as requested by Dan for his profile):
Who am I? Do we define ourselves? Or do others define us? Or do our actions define us? Identity is challenging. Am I defined by my journey as a Trial Lawyer who wages epic battles with evil corporations and insurance companies? Or am I defined by the $50,000 settlements that change my client's lives? Am I defined by my childhood, growing up always wanting to be an actor, a trial lawyer, or a president of something? I failed (quit) my movie star pursuit in Hollywood, does that boost my cred or detract from it?
Am I defined by family? My three young boys (3, 7, 9) mean more to me than any case and I would quit practicing law tomorrow if it was somehow necessary to help my kids. I wish I had more hours in the day to spend with them. And yet, when I look at them, I think of my toxic tort client who was diagnosed with Leukemia at 18, has lost one leg and likely another because of a company's toxic emissions, and I imagine if this happened to one of my children. Or am I defined by my pursuit of Karate and mastery of the bow and spear so that one day I may fight like the Viper of Dorne as my client's champion?
