Wrongful death and traumatic brain injury often bedevil the most experienced trial counsel grasping for a way to wind their way through the maze of biases against your clients. The “Two Bites Of The Apple” approach allows you to eliminate the EXTREME biases which absolutely exist in both of these types of cases and yet then have the remaining jurors truly rally around the rock solid foundation that the values of the life and the value of preserving the core of who you are as an individual (i.e., a healthy brain) are in fact the bedrock values promised each American in the Declaration Of Independence (life, liberty and the pursuit of happiness). There will be a 1 hour lecture dedicated to voir dire death and then a separate 1 hour lecture on traumatic brain injury which will set out the critical principles of successful voir dire on both of these important types of cases.
All participants must submit specific cases either on wrongful death or traumatic brain injury so that there can be a group discussion to identify the problem jurors and then to harness the winning principles that do absolutely exist in all of our cases on these critically important topics. As to how to identify those people who would say, “This case is not the right one for me . . . perhaps another one would be best.” We will also discuss the segue into talking in an efficient manner with the others who have not stated “this is not the right case for me.” We then have them explain why sitting on a jury to value such an important matter as life or a healthy brain is in fact one of the more important tasks any jury can decide.
